1. Acceptance of Terms

Welcome to Fortune Academy. These Terms and Conditions ("Terms") govern your access to and use of our website, services, and educational courses. By accessing or using Fortune Academy's services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

2. Definitions

• "Fortune Academy," "we," "us," or "our" refers to Fortune Academy and its affiliated entities.
• "User," "you," or "your" refers to any individual or entity accessing or using our services.
• "Services" refers to all educational courses, programs, content, and related services offered by Fortune Academy.
• "Content" refers to all materials, including text, videos, images, and interactive elements provided through our services.

3. Eligibility

You must be at least 18 years of age to use our services. Students enrolling in South Carolina Real Estate classes must also be a high school graduate or hold a certificate of equivalency (GED). Your registration is contingent upon verification, valid payment, and confirmation of no past or outstanding debts or restrictions. By using Fortune Academy, you represent and warrant that you meet these requirements and have the legal capacity to enter into these Terms.

4. Account Registration

4.1 Account Creation

To access certain services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms, without notice or liability.

5. Course Enrollment and Access

5.1 Enrollment

Course enrollment is subject to availability and acceptance by Fortune Academy. We reserve the right to refuse enrollment or cancel registration at any time.

5.2 Course Access

Upon successful enrollment and payment, you will receive access to course materials for a specified period. Access periods vary by course and are non-transferable.

5.3 Prerequisites and Requirements

Some courses may have prerequisites or technical requirements. You are responsible for ensuring you meet all requirements before enrolling.

6. Payment Terms

6.1 Fees and Charges

All fees are stated in U.S. dollars and must be paid in full at the time of enrollment unless a payment plan has been approved. Prices are subject to change without notice.

6.2 Payment Methods

Tuition can be paid by check, money order, credit card, or cash, and is due at the time of registration. We also accept PayPal and approved purchase orders. By providing payment information, you authorize us to charge the applicable fees.

6.3 Refund / Cancellation Policy

For Live Training: Refund or cancellation requests will be accepted up to three business days before the class start date. Individuals withdrawing within this period will receive a 100% refund of the course fees with a deduction of $25 for service charges. Refunds will not be processed for individuals who have attended any portion of the course. Refunds will be issued within 15–20 business days of the request. Class rescheduling can be requested by the student or may be required by management, up until a day before the class start date; new class schedule options will be provided to select from.

For Online Training: Both the Online Interactive and Online Self-Paced learning methods have expiration dates: Real Estate Agent Licensing and Broker Licensing courses expire 6 months from the purchase date, and Property Management License Training expires 3 months from the purchase date. Refunds can be requested before course access has been provided. Once course logins have been emailed to the student, no refunds will be issued. The school may provide store credit or allow switching to another course within 3 days of the initial purchase, provided that the course has not been launched.

7. Intellectual Property Rights

7.1 Ownership

All content, materials, and intellectual property provided through Fortune Academy's services are owned by or licensed to Fortune Academy and are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use course materials solely for your personal educational purposes. You may not:

• Copy, reproduce, distribute, or publicly display course materials
• Modify, create derivative works, or reverse engineer course content
• Share login credentials or course access with others
• Use content for commercial purposes
• Remove copyright or proprietary notices

8. User Conduct

All students are required to maintain professional behavior at all times. You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Engage in academic dishonesty or plagiarism
• Harass, abuse, or harm other users or staff
• Use our services for any illegal or unauthorized purpose

No disruptive or aggressive behavior, or threats of physical violence, will be tolerated. Two warnings will be given in such cases; if the offending behavior continues, the student will be expelled from the class at the discretion of management and the fee paid for the class will not be returned. Fortune Academy has a zero-tolerance policy for cheating during class exams: students caught using unfair methods will be reported to the South Carolina Real Estate Commission and their school registration will be cancelled.

9. Content Accuracy and Changes

9.1 Course Content

We strive to provide accurate and up-to-date course content. However, we do not warrant that course materials are error-free or that they will meet your specific requirements.

9.2 Right to Modify

We reserve the right to modify, update, or discontinue courses or content at any time without notice.

10. Disclaimers and Limitation of Liability

10.1 Service Provided "As Is"

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 No Guarantee of Results

While our courses are designed to meet licensing requirements, we do not guarantee that completion of our courses will result in obtaining a license, certification, or employment.

10.3 Limitation of Liability

To the fullest extent permitted by law, Fortune Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers or your personal information
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, or similar harmful code
• Any errors or omissions in content

Our total liability shall not exceed the amount paid by you to Fortune Academy in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fortune Academy and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of our services or your violation of these Terms.

12. Third-Party Services

Our services may contain links to third-party websites or services that are not owned or controlled by Fortune Academy. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions.

13.2 Arbitration

Any dispute arising from or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Myrtle Beach, South Carolina.

13.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Fortune Academy individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Modification of Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, along with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Fortune Academy regarding the use of our services.

17. SMS Communication

• By providing your phone number on our website forms, you consent to receive SMS messages from Fortune Academy related to your inquiry, appointment scheduling, or course information.
• Message frequency may vary. Standard message and data rates may apply.
• You can opt out at any time by replying STOP to any message. For assistance, reply HELP.
• We do not share or sell your phone number to third parties for marketing purposes.
